Does the 2025 THC Hemp Ban affect CBD?

Congress just passed a THC Hemp ban in the bill to re-open the government, which has been signed by the President on 11/12/2025. This bill will close the loophole that allowed THCa products to be produced and sold by disputing the Total THC testing requirements outlined by the USDA. The ban will include other intoxicating cannabinoids that were not initially covered under the 2018 farm bill, like Delta 8 and similar cannabinoids yet to be outlined in the total allowed amounts. It also adds a 0.4 mg THC cap per package which eliminates the currently 0.3% compliant THC products like beverages and gummies.
How does the THC Hemp Ban affect CBD products? The new 0.4 mg THC cap will completely wipe out raw compliant CBD flower which while 0.3% compliant would fall above the new THC cap. It will also knock out the majority of full spectrum CBD products with minimal THC, many of which are typically at or below 1-3 mg per serving.

How will the ban affect the products at Ceilidh's Cannabis Conjurations? The majority of our products will be unaffected by the new ban. All varieties of our CBG flower, end use sublinguals, topicals, and hempseed skincare items have non-detectable levels of THC and will not be affected. As stated before the new cap will eliminate all varieties of our CBD flower for direct consumer sale. We will be able to provide the current remaining stock over the next year before the new laws take effect in November of 2026.
What can we do moving forward? The one year date does give some time to potentially make changes to the ban before it's enactment. We along with the IHGA will make every effort to petition our legislators for change at the federal and state levels and send updates via our newsletter.
